Wasserman Schultz Statement on Obama Administration’s Actions against Russia

. Rep. Debbie Wasserman Schultz (FL-23) issued the following statement today after the Obama Administration announced its response to Russian interference in the 2016 election:

“Russia’s unprecedented assault on our democratic process demanded a strong response, and the sanctions announced by the Obama Administration have sent a much-needed message to Moscow that we will punish anyone who meddles in our elections.

“That response was backed by a joint F.B.I. and Department of Homeland Security report that concluded Russian intelligence services were involved in 'an ongoing campaign of cyber-enabled operations directed at the U.S. government and its citizens.'

“Now Congress must take up its responsibility, and immediately launch a bipartisan, public investigation into these cyberattacks. Not only will it more fully uncover how the Kremlin hacked their way into our democratic process, but just as importantly it will show us how to stop this from ever happening again.

“Americans deserve to feel confident that a foreign power isn’t interfering with how we elect our most powerful leaders. Only a bipartisan, public Congressional investigation into this historic cyberattack on our democracy can help restore that faith.”

Rep. Deutch Calls for Veto of UN Security Council Resolution

 Congressman Ted Deutch (FL-21), Ranking Member of the House Foreign Affairs Subcommittee on the Middle East and North Africa, issued the following statement on a possible vote in the United Nations Security Council on Israeli settlement activity:

"Once again, I urge the Administration to veto this one-sided resolution that will do nothing to further peace efforts. As 393 of my colleagues and I stated unambiguously in a letter to President Obama in April, the UN Security Council is not the venue for advancing conditions for peace. Achieving a lasting and permanent solution with two states for two peoples will only come through direct, bilateral negotiations between the parties."

In April, Congressman Deutch led a letter to President Obama, urging him "to continue to insist that it is only at the negotiating table – and not at the UN – that the parties can resolve their complicated differences. Your continued commitment to longstanding U.S. policy to veto one-sided UN Security Council resolutions remains fundamentally critical."

“As a Member of the State and Foreign Operations Appropriations Subcommittee, I strongly oppose this one-sided resolution, which obstructs the road to peace, and welcome the decision to pull it from consideration today. One-sided, anti-Israel resolutions thwart the peace process, and have no place at an international forum such as the UN. The only way to resolve the conflict is through direct negotiations between Israel and the Palestinians, and the United States should oppose any efforts short of that, which will only delay us and move us further away from a lasting peace.”

Greetings, What a month it has been. Since our last edition, we’ve held an election, sworn in new City and County Commissions, had a Thanksgiving Feast and that just scratches the surface. So much has happened, and I would like to jump right into the news of the day. But before I do, there is a general statement that I would like to make about the state of our politics and our polity. That is, campaigns can often be fought on what divides us, and that’s ok. It is ok to disagree, and it’s ok to have serious philosophical disagreements about government, politics, religion and other important matters with your friends, your family and your neighbors. But when the campaigns are over, and the votes are cast, we need to remember that governing must be about those things that we can agree on. I’ve never met another person during my years in public service that I cannot find at least one item of policy to agree on. So it is ok to have serious disagreements, but we cannot let our disagreements blind us to the good that still exists in other people. With that in mind, let us work to continue to see the good in one another. That is going to be the only way we can preserve those things that make our society good. New Broward County Commission On November 22nd Broward County swore our new County Commissioners, Nan Rich, Michael Udine and Steve Geller into office, and the Commission elected Barbara Sharief Mayor and me as Vice Mayor. Congratulations to Commissioners Tim Ryan and Dale Holness on their re-elections New Hollywood City Commission Also on November 22nd the City of Hollywood swore in new Mayor Josh Levy and new Commissioner Debra Case into office, and the Commission elected Peter Hernandez as Vice Mayor. Congratulations to Vice Mayor Peter Hernandez, and Commissioners Dick Blattner and Linda Sherwood on their re-elections. Special thanks to Patty Asseff for her years of public service. Hollywood’s New Mayor Josh Levy and New Commissioner for District 1, Debra Case New Hallandale Beach City Commission On November 28th the City of Hallandale Beach swore in new Commissioner Anabelle Taub, and the Commission elected Keith London as Vice Mayor. Congratulations to Mayor Joy Cooper and Commissioner Michele Lazarow on their re-elections. Special thanks to Bill Julian for his years of public service Coastal Management Area/Water Quality Testing The County Commission voted to adopt the recommendations of the Coastal Oceans Task Force on December 6th 2016. This week I’m going to Tallahassee to meet with the Secretary of the Florida Department of Environmental Protection, Jonathan P. Steverson. We will be sitting down with Secretary Steverson, with legislation in hand to create a Coastal Management Area for the entire set of Coral Reefs from St. Lucie County South to Miami Dade. In addition to creating a Coastal Management Area, we are working with our State Legislators - including past chair of the Coastal Oceans Task Force, Representative Kristin Jacobs - to provide funding for Water Quality Testing at 100 sites along this Coastal Management Area. The Southeast Florida Coastal Ocean Task Force (COTF) was established in 2012 through enabling resolutions of the Boards of County Commissioners of Miami-Dade, Broward, Palm Beach, and Martin Counties. The Task Force was charged with providing recommendations for coastal ocean resources and conservation priorities and strategies. The Task Force finalized a set of 200 recommendations for best practices to preserve the Florida Reef Tract, as well as broader coastal area. From this list of 200 recommendations, the Coastal Management Area and the Water Quality Testing were two of the top priority actions. If we are successful in creating this Coastal Management Area, and getting the funds to perform water quality testing, we will be taking a huge step toward saving our Florida Reef Tract. DENIED! Florida Department of Environmental Protection Denies Kanter Realty’s Application to Drill  In other good news, the State of Florida’s Department of Environmental Protection has denied the permit from Kanter Realty LLC to drill for oil at a site in Broward County, 6 miles West of Miramar. I was thrilled to hear this, as it struck me as absurd that anyone would want to drill or frack for oil and gas in The Everglades. The County Commission had passed resolutions opposing Fracking in the State of Florida, and we have outlawed Fracking within our borders, but there was always a question of whether this lone permit might be granted by FDEP. We know that this permit has been denied, and this should be the end of the issue. You can read more about this in the Sun Sentinel and the Miami Herald. Penny Tax Survey I was disappointed to see that only one of the half-penny surtax questions passed this November. By inter-local agreement with the County and the Cities, both questions had to pass or both would fail. So even though the Transportation Half Penny Question passed with 51.10% of the vote Countywide, the corresponding Infrastructure Half Penny failed. In fact there was a difference of over 85,000 votes between those who voted against the Transportation Surtax and those who voted against the Infrastructure Surtax. That is why I would like to invite you to take the following quick survey regarding your thoughts and feelings about the Penny Surtax, so that the County and the Cities can better understand the will of the voters. Take Survey Waste Management Leachate Agreement Finalized – Thank you to everyone who called, wrote, emailed their support for this Agreement! In other good news, the County Commission approved an agreement with Waste Management to continue treating the leachate (garbage water) running off the Monarch Hill Landfill. This contract is in effect until the year 2062. This is a huge win for the public, considering that Waste Management was exploring the possibility of building a deep injection well to shoot untreated leachate (garbage water) under our water supply. Close Up Foundation and The Broward County Public Schools Bilingual/ESOL (English as a Second or Other Language) Department – Broward Youth Policy Summit Expo Dr. Fred Lippmann, BSO Lt. Mercazallo, Vice Mayor Beam Furr, Dr. Samantha Danachuck, Dr. Rosiland Osgood – Moderator Megan Turetsky with Broward County Public Schools  I had the pleasure of serving on a panel to hear questions from three hundred immigrant high school students from throughout Broward County. The Broward Youth Policy Summit Expo was organized by the Broward County Public Schools ESOL Department and the Close Up Foundation. The Close Up Foundation helps young people see how policy is developed in Federal, State and Local Government. It was a pleasure to hear from these students who have worked so hard to develop a youth agenda for Florida policy action. This event was a follow up to our 2015-16 Close Up – “Rally to the Tally” where students presented their legislative agendas to state elected officials in Tallahassee. Back when I was student at South Broward High School, I was one of the participants in this event, and I’m glad to see it is still going strong. Students participated from Blanche Ely, Boyd Anderson, Coconut Creek, Coral Glades, Coral Springs, Cypress Bay, Dillard, Everglades, Flanagan, Fort Lauderdale, McArthur, Miramar, Monarch, Northeast, Piper, Plantation, South Broward, South Plantation, Stoneman Douglas, Stranahan, Taravella, and Western High Schools Great News from the Port Everglades Advocacy Team – PEAT After almost twenty years, the Port Everglades Widening and Deepening project appears to be on the verge of being officially authorized. On Saturday December 10th, the Senate passed the Water Infrastructure Improvements for the Nation act “WIIN” (previously WRDA) by a vote of 78-21. The same bill was previously passed by the House of Representatives 360-61. It is expected to be signed by President Obama. Specifically, the bill authorizes the Deepening and Widening Project at Port Everglades and the Central Everglades Project. Shortly before the WIIN vote, the Senate passed and President Obama signed a continuing resolution that extends government funding until April 28th, 2017 with a cap of $1.07 trillion. There are a few more steps to go, but this is a huge milestone. This green light will then move our project from the Authorization Phase into the critical next phase, Appropriations 61st Annual Candy Cane Parade on Hollywood Beach I was happy to participate in the City of Hollywood’s 61st Annual Candy Cane Parade on Hollywood Beach. It was a beautiful night, and the crowd was happy to see the floats and marching bands come down the Broadwalk. Rep. Debbie Wasserman Schultz (FL-23) issued the following statement after the passage of the Water Infrastructure Improvements for the Nation Act:

“The passage of the Water Infrastructure Improvements for The Nation Act (previously known as the Water Resources Development Act of 2016, or “WRDA”) is a critical step forward in protecting and restoring our state’s environmental treasures and key resources. In particular, I am proud that with our South Florida congressional delegation's advocacy, WRDA contains $1.9 billion for the Central Everglades Project (CEP), which will improve water flow in and around the Everglades and help restore the health of our “River of Grass.” Port Everglades, which is in my congressional district, is the centerpiece of economic activity in Broward and South Florida. I'm proud to have helped secure, after nearly 18 years of teamwork, funding of more than $335 million for the Port Everglades Harbor Dredging Project, which will help South Florida’s economy maintain and expand its position as a hub of international trade and commerce. 

“In addition, WRDA and the Continuing Resolution contain more than $145 million for programs to address the Flint water crisis. I visited Flint earlier this year to hear firsthand from its residents how this tragic crisis has impacted them. I was devastated to hear from the mothers of Flint, who had to worry about bathing and washing their children in lead-contaminated water. I am glad that the families of Flint will finally receive the funding they need, but I am appalled that this aid is coming many months later than it should have. The people of Flint did not deserve to wait this long, or any longer, for programs that will help their community rebuild from a tragedy of epic proportions.”

Can The Courts Remove Trump From Office

In light of revelations on Friday that Russian hackers interfered with the presidential election specifically to elect Donald Trump, Clinton supporters and advocates of free democracy are eagerly searching for potential measures to prevent Trump from assuming the presidency at the hands of the Kremlin. One important legal precedent for such an impeachment is Marks v. Stinson, a 1994 case in which the U.S. Supreme Court invalidated a state senate election and ordered the vacancy to be filled by the losing opponent after massive fraud was uncovered.

The Pennsylvania state senate held a special election in 1993 to fill a seat left vacant by the death of the previous senator. The contest pitted Republican Bruce Marks against Democrat William Stinson, who was ultimately successful in winning the seat. After Stinson was elected, however, evidence of widespread fraud in the election came to light.

Moreover, two elected officials testified under oath that they had been aware of the fraud and did nothing. Thus after Stinson had already taken office a federal judge ordered that he vacate his seat within 72 hours and hand it over to Marks, a ruling that was maintained upon appeal by the Supreme Court.

While the circumstances of the 1994 case are obviously significantly different from the controversy surrounding last month’s election, the ruling does establish some degree of a precedent for a high court overturning the results of an election based on evidence of malfeasance.

Thus if it becomes clear that Donald Trump won the presidency because of Russian interference – which, while hard to prove, does not seem out of the question – it would be possible for a court to invalidate the results and install Hillary Clinton. In Marks v. Stinson the testimony of the two elected officials who knew of the fraud proved crucial to the case.

Thus revelations that Mitch McConnell was aware of the Russian hacks and that members of Trump’s team were holding secret meetings with the Kremlin during the campaign bode well for any such impeachment effort.

Besides direct litigation there are several other efforts underway to prevent Trump from assuming the presidency. Chief among these is the campaign to convince Electoral College members to act as conscientious electors and vote for Clinton instead of Trump.

While Trump’s 37 vote lead in the electoral college makes such an effort unlikely, many have argued that the very reason the electoral college exists is to prevent a demagogic populist like Trump from riding to the presidency on a wave of ignorant anger.

Moreover, an online petition urging the Electoral College to vote for Hillary has surpassed five million signatures. As unlikely to succeed as these moves may seem, every effort we can make is worth it to protect this country, the world, and its people from a Trump presidency. And the fact that Trump seems to have won his victory with the aid of interference by a hostile foreign dictatorship is all the more reason to fight against his installation as the most powerful man in the world.

Good Citizen,

I am sorry that, because I have received more than 75,000 emails, I can no longer personally respond to you. I gave up after about 1200. Given that the content is fairly universal, I am comfortable offering this universal response.

Thank you for your communication and for your passion for the Republic. I prefer writers to rioters.

Several things merit mentioning. First, you have every right to lobby an elector. I delight in receiving this type of communication from a fellow American.

Second, this is not a pure democracy, it is a republic. The corollary to that fact is that even if the majority did rule, and it does not, there was no absolute majority winner in this election.

Third, the Electoral College does not exist in order to give you a "do over" because you don't like the results; it exists to preserve the nature of the the republic.

Finally, your feelings notwithstanding, it is not my duty to care one whit what the plurality or majority of Americans want. My job is to represent the decision of the winning party in the Texas Presidential election.

It's not that your feelings don't matter at all, they just don't matter here. The law and U.S. Constitution do.

For those who believe I should change my vote to HRC because of your intense feelings about Donald Trump, surely you must know that for every person who feels you have elected the worst person to ever hold the office, there is another who would have felt exactly the same that had we elected HRC: that she is unfit for office and her husband has committed multiple sexual assaults.

Nevertheless, I think it safe to say, my good citizen, you would not have agreed with electoral nullification of a Clinton victory. Nor would I.

This is why we have elections.

If you disagree with the electoral college concept, and some do, you have the opportunity amend the constitution. But elector nullification is not the answer.

I will vote my conscience. You need have no fear. I have never intended to do anything more or less.

Please allow me to illustrate my point with an analogy from America's favorite pastime, baseball. In the 1960 World Series the Pirates beat the Yankees 4 games to three. But, the Yankees scored a total of 55 runs while the Pirates could only muster 27 total runs.

Unfair? No, those are the rules of baseball. We choose the winner of the World Series by number of games won, regardless of the disparity of the total runs. If the rules were different, teams would strategize differently and the result would likely be different. That the Yankees outscored the Pirates in 1960, or that the Cubs tied the Indians in runs scored this year, is nothing more than an interesting statistic.

In a Presidential campaign, if the rules were different, candidates would strategize differently and the result would likely be different. Donald Trump won according to the rules. Everything else, including the popular vote, is merely an interesting statistic.

Indirect election of the chief executive is the rule under parliamentary forms of government. No one in Canada or the United Kingdom votes for Prime Minister. The election is indirect.

In closing, I am delighted that many are reading the Federalist Papers. I've been reading them for twenty years. They are a fascinating insight into the minds of the framers of the Constitution, aren't they? The Anti-Federalist papers, from which came the Bill of Rights, are equally educational. I recommend them for your reading also.

Yes, I agree with Hamilton in Federalist 68. No, I do not believe that the election of Donald Trump rises to that level. Consequently, to those who would have me vote for some Republican other than Trump, I decline for the same reason.

Election Recount Lawsuit Filed In Florida

Protect Our Elections, Filed the suit in a Florida court on Friday  In a thirteen page PDF copy of the official court filing, which the nonprofit group in question has publicly posted to its website, numerous details stand out. The suit from the law offices of Clint Curtis has named dozens of defendants. Chief among them: Donald Trump, Mike Pence, Florida Governor Rick Scott, and Florida Attorney General Pam Bondi. Individuals appointed to the Electoral College by the state of Florida are also listed as defendants, as they’re the ones who would be changing their votes if a Florida recount determines that Hillary Clinton actually won the state.

“Donald Trump campaigned on promises to hold government officials accountable by ‘draining the swamp’ – but apparently those pledges don’t apply to Mr. Trump or his cronies. In fact, his meeting with Florida Attorney General Pam Bondi is anything but that. Earlier this year, alarmed Floridians raised questions about whether Bondi – our state’s highest ranking law enforcement official – had engaged in a troubling and potentially illegal pay-to-play scandal with the President-Elect over Trump University, his higher education sham over which he’s since had to pay an unprecedented $25 million fine. Attorney General Bondi declined to pursue a similar case in Florida after Mr. Trump made an illegal donation to her campaign, in which he made a political contribution from his charitable foundation. Now, they are meeting behind closed doors, ostensibly to discuss a job. It’s time to come clean. The Attorney General and the President-Elect need to once and for all speak honestly about Trump University and his campaign contributions – instead of rewarding illegal behavior with the spoils of victory.
